Terms of service

Last updated

These terms are an agreement between you and KRAFA LLC ("FuseProxy", "we", "us"), 30 N Gould St Ste N, Sheridan, WY 82801, US. They apply when you create an account, buy proxies or use the FuseProxy website, dashboard or API. If you use FuseProxy for a company, you accept these terms on its behalf and confirm that you may do so.

1. The service

FuseProxy sells access to proxy servers: rotating residential, datacenter and mobile proxies billed per GB of traffic, and, when available, dedicated ISP proxies billed per IP for a fixed term. The current products, prices and limits are on fuseproxy.com, the pricing page and in the documentation.

Our proxy network is operated together with third-party network partners. Routes, IP addresses and the countries available change over time.

2. Your account

  • You must be at least 18 years old and able to enter a binding contract.
  • FuseProxy is not available to users in the countries listed in the acceptable use policy.
  • Each person or company may have one account, unless we agree otherwise in writing.
  • Give accurate account details and keep them up to date. You can sign up with an email address and password, or with Google.
  • Keep your password and proxy credentials secret. You are responsible for everything done with your account and credentials.
  • Once your purchases pass $500 in total, you need to verify your identity with Stripe Identity before your next order. We may also ask you to verify, or to describe your use case, at any time before you buy or keep using certain products. We may decline or close accounts we cannot verify.

3. Acceptable use

You must follow the acceptable use policy, which is part of these terms. Breaking it is a material breach of these terms.

4. Payments

  • Prices are in US dollars and shown before you pay. Taxes are added where the law requires.
  • Payment is taken in advance through Stripe. We do not see or store your full card number.
  • Per-GB traffic is added to your account once the payment succeeds, and each GB you use is deducted from it. Traffic does not expire. Some targeting options, such as city, state, ZIP code and network targeting, use traffic at a higher rate, as described in the documentation.
  • Refunds are covered by the refund policy. Payment processing fees are not refundable.
  • We may change prices for future purchases. Changes never affect traffic you have already paid for.

5. Availability and support

We work to keep the service available and fast, but we do not guarantee that it will be uninterrupted or error-free, that a particular IP, location or website will be reachable, or that any website will accept proxy traffic. We may carry out maintenance, and change or discontinue features, with reasonable notice where we can give it.

Support is available through Email, Phone.

6. Suspension and termination

  • You can stop using FuseProxy and ask us to close your account at any time.
  • We may suspend or close your account immediately if you breach these terms or the acceptable use policy, if your payment is disputed, if we are required to by law, or if your use puts our network, our partners or others at risk.
  • When an account is closed for a breach, unused traffic is not refunded and can no longer be used.
  • Some websites forbid proxy traffic in their own terms. We are not responsible if a third party blocks or restricts your account on their service.

7. Your responsibilities

You are responsible for how you use the proxies and for the data you collect with them, including complying with the laws and website terms that apply to you. You will compensate us for claims, losses and costs (including reasonable legal fees) that arise from your breach of these terms or your use of the service.

8. Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties not stated in these terms, including fitness for a particular purpose and non-infringement.

9. Limitation of liability

To the extent the law allows:

  • We are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or business opportunities.
  • Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms limits liability that cannot be limited under applicable law.

10. Changes to these terms

We may update these terms. The date at the top shows the latest version. We will tell you by email about significant changes before they take effect. If you keep using FuseProxy after a change takes effect, the new terms apply.

11. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Courts in Wyoming have exclusive jurisdiction, unless the law of your country gives you the right to bring a claim where you live.
